Mindwire — Terms of Service
1. Agreement
These Terms of Service ("Terms") form a binding agreement between you and Sajin Payandath ("Mindwire", "we", "our", "us") governing your use of the Mindwire iOS app, the Mindwire web app at mindwire.app, and related services (together, the "Service").
By creating an account or using Mindwire, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What Mindwire is
Mindwire is a personal reflection journal and daily-writing companion. It helps you write daily notes, reflections, gratitude entries, and guided-reflection responses, and offers an AI conversation partner that responds in the context of your past journal entries. Mindwire is a lifestyle and productivity tool for building a journaling habit and for personal reflection.
3. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to create an account. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4. Your account
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- Provide accurate information when you register and keep it up to date.
- Notify us at support@mindwire.app if you believe your account has been compromised.
- One person per account. Do not share your account with others.
5. Your content
5.1 You own what you write
You retain all rights to the journal entries, reflections, gratitude notes, photos, and chat messages you create in Mindwire ("Your Content"). We do not claim ownership of Your Content.
5.2 License to operate the Service
You grant Mindwire a limited, worldwide, royalty-free license to store, process, display back to you, and transmit Your Content solely to provide the Service to you. This includes encrypting and decrypting Your Content on our servers and sending relevant excerpts to our AI-model provider when you use the chat feature. This license ends when you delete Your Content or your account.
5.3 We do not use Your Content to train AI models
We do not use the contents of your journal entries to train, fine-tune, or evaluate any machine-learning model.
5.4 Back-ups
We take reasonable steps to back up your data but cannot guarantee against all loss. We recommend exporting your journal entries periodically.
6. Acceptable use
You agree not to:
- Use Mindwire for any unlawful, harmful, or abusive purpose.
- Upload content that is illegal, infringes others' rights, or that you do not have the right to share.
- Attempt to access another user's account or data.
- Probe, scan, or test the vulnerability of the Service without our prior written permission.
- Scrape, automate, or access the Service other than through our official clients.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, except where such restriction is prohibited by applicable law.
- Use the Service to harass, abuse, or harm another person.
- Interfere with the Service's operation or impose an unreasonable load on our infrastructure.
- Resell, sublicense, or commercially exploit the Service without our written permission.
We may suspend or terminate your access if we believe you have violated these Terms.
7. AI-generated content
Mindwire's AI conversation partner uses a large language model to generate responses. You understand and agree that:
- AI responses are generated automatically and may be inaccurate, incomplete, or unsuitable for your situation.
- AI responses are not professional advice of any kind — medical, psychological, legal, financial, or otherwise.
- You should use your own judgement before acting on any AI response.
- We make no guarantees about the availability, accuracy, or fitness of AI-generated content for any particular purpose.
8. Not a substitute for professional care
Mindwire is a personal reflection journal, not a clinical service. It is not a substitute for professional mental health care, medical advice, diagnosis, or treatment. If you are experiencing a crisis or need professional support, please contact a qualified professional or a local crisis line. In the United States, call or text 988 (Suicide & Crisis Lifeline).
If Mindwire detects language suggesting you may be in distress, it may surface support resources such as crisis lines. These resources are provided for your convenience and do not constitute professional advice.
9. Price and payments
The core Mindwire app is free to use at launch. If we introduce paid features, subscriptions, or in-app purchases in the future, we will provide clear pricing and billing information before you are charged, and any purchases will be processed through Apple's App Store subject to Apple's standard terms.
10. Service availability and changes
We work hard to keep Mindwire available, but we do not guarantee uninterrupted or error-free operation. We may update, modify, suspend, or discontinue features of the Service at any time. We may require you to update to a newer version of the app to continue using the Service.
11. Termination
- You can terminate these Terms at any time by deleting your account in the app under Profile > Delete Account. Deletion is permanent after the 30-day archive window described in the Privacy Policy.
- We may suspend or terminate your account if we believe you have violated these Terms, if required by law, or if we discontinue the Service. Where reasonably possible and permitted, we will notify you in advance.
- Sections that by their nature should survive termination (ownership of Your Content, disclaimers, limitations of liability, and dispute resolution) will survive.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MINDWIRE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR ANY PURPOSE.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions the above exclusions apply to the maximum extent permitted by law.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDWIRE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $20.
14. Indemnification
You agree to indemnify and hold Mindwire harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of applicable law or third-party rights.
15. Apple-specific terms (iOS app)
The following terms apply to the iOS app obtained through the Apple App Store and are required by Apple's standard EULA.
- These Terms are between you and Mindwire only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or a third party relating to the app or your use of it.
- In the event of a third-party claim that the app infringes intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.
16. Governing law and disputes
These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms will be resolved exclusively in the courts located in Bangalore, Karnataka, India, except that either party may seek injunctive relief in any competent court.
If you are a consumer in the European Union, nothing in this section limits your right to bring proceedings in the courts of your country of residence under applicable consumer-protection laws.
17. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will notify you in-app or by email and update the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance.
